These terms govern your use of the Curbside website at https://buildwithcurbside.com, our Spotlight listing app, and the design, build, and care services we provide. By using this site, creating a Spotlight account, or engaging us for work, you agree to these terms.
Who we are
Curbside designs, builds, and maintains websites for real estate agents. In these terms, "we," "us," and "our" mean Curbside, and "you" means the person or business using this site or buying our services.
The service we provide
We build agent websites on a one-time build fee, and we keep them hosted and maintained through an optional monthly Care plan. The specific pages, features, and timeline for your project are agreed in writing before work begins.
Spotlight listing pages
Spotlight is a free tool that lets an agent publish single-property listing pages and share them by link or QR code. Free accounts can keep a limited number of listings active at once. Spotlight is provided at no cost, and we may change, limit, or discontinue it, or change the free limits, at any time. We may also remove a listing or suspend an account that breaks these terms or the law.
Your Spotlight account
You sign in to Spotlight with a magic link sent to your email, so keep access to that inbox secure. You are responsible for activity under your account and for keeping your profile and listing details accurate and current. Spotlight is for licensed real estate professionals marketing their own listings.
Your listing content
- You keep ownership of the content you publish through Spotlight, including your photos, descriptions, and profile. You grant us permission to host, display, and deliver that content so we can operate Spotlight and show your listing pages.
- You must have the right to use everything you upload, including listing photos, and it must not infringe anyone else's rights.
- Your listings must be accurate and must follow the rules that apply to real estate marketing, including license and disclosure requirements, and fair housing and advertising laws. You are responsible for the claims and content on your listing pages.
Buyer inquiries
Inquiries that buyers submit through your listing pages are yours. We store them and pass them to you so you can follow up, and we are not a party to your dealings with those buyers. You are responsible for handling their information lawfully.
Data processing
When we process the personal information of your buyers on your behalf, you are the controller (or business) and we act as your processor (or service provider). Our Data processing addendum describes how we handle that information, including our sub-processors and our service provider commitments, and it forms part of these terms.
Quotes, pricing, and payment
- Build fees are one-time and are quoted before work starts. Care plans are billed monthly in advance and run month to month.
- Payment is collected through our payment processor (Stripe). You are responsible for the fees shown at checkout and any applicable taxes.
- You can cancel a Care plan at any time. Cancellation stops future monthly charges and does not refund the current period or the one-time build fee.
What you own
When your build is paid in full, the website we deliver is yours. You own the code, your domain, your content, and your leads, and you can take all of it with you if you ever leave. We retain ownership of our own tools, templates, and the Curbside marketing site, none of which are part of your deliverable.
Your responsibilities
- Give us accurate information and the content, photos, and approvals we need to do the work.
- Make sure the content you provide is yours to use and does not infringe anyone else's rights.
- Follow the rules that apply to real estate marketing, including license and disclosure requirements, and fair housing and advertising laws. You are responsible for the claims and content on your own site.
Timelines and results
Timelines such as "live in 72 hours" are good-faith targets that depend on getting your content and approvals on time. We do not guarantee any specific search ranking, traffic, or number of leads. Search and AI tools are controlled by third parties and change often, and many factors are outside our control.
Intellectual property
The Curbside name, this marketing site, and its content are ours. Your delivered site and your content are yours. Neither side may use the other's brand or content beyond what these terms or a separate written agreement allow.
Third-party services
Your site and our service rely on third parties such as hosting and edge networks, image storage and delivery, payment processing, email delivery, AI-assisted form filling, and analytics. We are not responsible for their outages, changes, or terms, and your use of those services may be subject to their own agreements.
Disclaimers
This website and our services are provided "as is" and "as available" without warranties of any kind, to the fullest extent allowed by law. We do not warrant that the site will be uninterrupted, error free, or free of harmful components.
Limitation of liability
To the fullest extent allowed by law, Curbside is not liable for indirect, incidental, or consequential damages, and our total liability for any claim related to the service is limited to the amount you paid us for that service in the three months before the claim.
Cancellation
Care plans are month to month. When you cancel, we stop future charges, and you keep your code, domain, and content. We will help hand over what is yours so your site can move with you.
Changes to these terms
We may update these terms from time to time. When we do, we will change the date above. Continuing to use the site or our services after an update means you accept the new terms.
Governing law
These terms are governed by the laws of the state in which Curbside operates, without regard to conflict of law rules. (Replace with your chosen jurisdiction before launch.)
